Automatic collection. We, our service providers, and our business partners may automatically log information about you, your device, and your activity over time on the Site and other online services, including:

  • Device data, such as your operating system, browser type, screen resolution, IP address, the website you visited before ours, and general location such as city, state, or region.

  • Precise geolocation data, only if you give permission through your device or browser settings.

Cookies and similar technologies. Some of our automatic data collection uses:

  • Local storage technologies, which work like cookies but can store larger amounts of data on your device.

  • Web beacons, also called pixel tags, which show that a page or email was viewed or clicked and help us measure the results of our marketing.

  • Software development kits and tracking pixels, provided by services such as Google, Meta, and TikTok, that allow those companies to collect data from our Site for analytics and advertising.

11. State law privacy rights

This section applies to residents of New Hampshire, California, and other U.S. states with privacy laws that give residents the rights described below. "Personal Information" has the meaning given to "personal data," "personal information," or similar terms under the law of your state. Not all rights are available to all users, and your rights may depend on where you live. In some cases we may provide a different privacy notice to certain categories of residents, such as job applicants, and that notice will apply instead.

Your privacy rights. You may have some or all of the following rights. These rights are not absolute, and in some cases we may decline a request as permitted by law.

  • Right to know. You can request information about how we have collected and used your Personal Information in the past 12 months, including the categories collected, the sources, the purposes, the categories of third parties we share it with, and whether we have sold or shared it.

  • Access. You can request a copy of the Personal Information we have collected about you.

  • Correction. You can ask us to correct inaccurate Personal Information.

  • Deletion. You can ask us to delete Personal Information we collected from you.

  • Opt out of sale, sharing, and profiling. You can opt out of the "sale" of your Personal Information, the "sharing" of it for targeted advertising, and profiling that produces significant effects, where applicable.

  • Sensitive Personal Information. We collect sensitive information, such as dietary and health-related data, only with your consent where required by law, and you may withdraw consent at any time. We use it only to provide the services you request.

  • Nondiscrimination. You may exercise these rights without discrimination in the form of denial of the Service or legally prohibited changes in price or quality.

How to exercise your rights. You can submit a request by emailing privacy@weeknightshandled.com. We cannot process a request unless you give us enough detail to understand it and verify your identity. We may need to confirm your residency and identity, and may ask for additional information for that purpose.

Authorized agents. You may designate an authorized agent to make a request on your behalf, subject to the verification the law allows us to require.

Appeals. If we deny your request, you may appeal by replying to our denial or emailing privacy@weeknightshandled.com with "Appeal" in the subject line. We will respond within the time required by applicable law.

Right to opt out of the "sale" or "sharing" of your Personal Information. We do not sell Personal Information for money. Like many companies, we use analytics and advertising services (such as Google Analytics, Meta, and TikTok) that collect device and online activity data from our Site. Under some state laws, this may be considered a "sale" or "sharing" of Personal Information. You can opt out by emailing privacy@weeknightshandled.com with "Do Not Sell or Share My Personal Information" in the subject line, and by using the Global Privacy Control in a participating browser. Your opt-out applies only to the browser and device you use to submit it.

Retention. We keep each category of Personal Information for as long as reasonably necessary to maintain the Service, meet legal and accounting obligations, and for the other purposes in this policy, unless the law requires or permits a longer period.

De-identification. We do not attempt to re-identify de-identified information, except to test whether our de-identification processes comply with the law.

Categories of Personal Information we collect, use, and disclose. In the past 12 months we have collected identifiers and contact information, commercial and transaction information, internet and device activity, geolocation (general), sensitive information (dietary and health-related data you choose to share), and inferences drawn from the above. The sources and purposes are described in Sections 1 and 2, and the categories of recipients are described in Section 3.

Additional information for other states. Residents of other states may have similar rights under their local laws. Contact us at privacy@weeknightshandled.com to make a request.

Notes for your lawyer (do not paste these)

  1. Entity and address. Confirm the LLC's exact registered name (I used "Weeknights, LLC") and that the Site, social accounts, and invoices all match. The policy lists email only. Ask whether that is sufficient for your situation, and which address to use in marketing email footers. CAN-SPAM requires a valid postal address, and a PO Box or commercial mail receiving address is generally acceptable.

  2. New Hampshire law. NH has its own consumer privacy act, and applicability depends on volume thresholds you may not meet yet. I drafted as if it applies so you are covered as you grow. Your lawyer should confirm whether it, or any other state law, applies now.

  3. Health and allergy data. Some states require opt-in consent before collecting sensitive health data. Ask whether your intake form needs a consent checkbox linked to this policy.

  4. Ad pixels on health-adjacent pages. Meta and TikTok pixels can create risk if they fire on pages or forms that reveal health information. Ask whether to turn them off on intake and account pages.

  5. Text messaging. Texting requires prior express written consent under federal rules (TCPA), with its own disclosures. This usually needs a separate SMS terms page and signup language.

  6. EU, Canada, Iceland. I kept this U.S. only. If you expand, GDPR (which also covers Iceland through the EEA) and Canadian law would require legal bases for processing, data transfer mechanisms, possibly a local representative, and an expanded rights section. It's best to add these when you actually launch there.

  7. Apollo. It is a data enrichment and prospecting tool, so I mentioned data providers. Confirm how you use it, since outreach using purchased contact data has its own rules (CAN-SPAM, opt-outs).

  8. Terms of Service and cookie banner. You'll likely want both, and a cookie consent banner if you serve EU visitors.

  9. Age cutoff. I used 18+. If you serve anyone younger, that changes the consent langua
